I’m in AZ and have received offer less than 2 weeks after recall was completed on my 2019 hse. I was told by Morley rep that they use kbb with all vehicles considered to be in excellent condition, and that the mileage doesn’t matter. Then when I spoke with “my” Morley rep, I was told condition and mileage do matter “every vehicle buyback price is different”. He also stated that the software fix “would” then changed to “should”, eliminate any concerns with the battery.
My offer is is no where near 35% of original msrp and in fact is half of that. I have had zero issues since purchasing her last year. As an fyi, the mileage is 70k and there are cosmetic issues. But as for asking for more, he stated I would need to provide documentation validating that the offer should be xyz.
I don’t know what to do. Do I keep her based on knowledge that I won’t be able to do much with that offer when looking at a replacement or bow out just in case?

No idea what documentation they want. Maybe provide documents showing what you paid for it plus something like the following:
Use Edmunds dot com (they have free value graph for the last 12 months) to find a gasoline powered Jaguar that isn’t subject to buyback with a similar mileage and value when you purchased it. Let them know you want the same amount as the current value of the sample non recalled vehicle. Seems like a reasonable “valuation” to me.

I'm thinking of filing a lawsuit under Magnuson-Moss. Not my practice area, but I'm pretty sure I can put together a decent complaint. At a minimum, I might get some discovery. How many Caesium Blue HSE trim I-Pace's with brown interior were shipped in the U.S.? I suspect not many, which should add to the appraised value of the car. I want to know what they're doing for Waymo as well.
